REFUND & CANCELLATION POLICY

This Refund & Cancellation Policy (“Policy”) governs the terms and conditions under which refunds may be granted by INVESMATE INSIGHTS PRIVATE LIMITED, a company incorporated under the Companies Act, 2013, having its registered office at 5 Narendra Nagar, Near Railway Booking Office, P.O. Belghoria, Kolkata – 700056, and branch offices at 137/1 B.T. Road, Dunlop, 2nd Floor, Nanaksar Tower, Above Bandhan Bank, P.S. Baranagar, Kolkata – 700108 (hereinafter referred to as “INVESMATE”, “Company”, “We”, “Us”, or “Our”), for its educational courses, training programs, live classes, recorded content, subscription services, and related offerings (“Services”).

This Policy shall not apply to the Power of Trading & Investing Combo Course, which is strictly non-refundable under all circumstances.

By enrolling in any course, subscribing to any service, or making any payment, the user (“Student”, “Consumer”, or “You”) expressly acknowledges, agrees, and consents to be legally bound by this Policy.

  1. Statutory Compliance & Consumer Rights
  1. This Policy is framed in compliance with the Consumer Protection Act, 2019, including but not limited to:
    • Section 2(7) – Definition of Consumer
    • Section 2(11) – Deficiency of Service
    • Section 2(47) – Unfair Trade Practice
    • Sections 49 & 59 – Jurisdiction of Consumer Commissions
  2. INVESMATE affirms that:
    • All material information regarding courses, pricing, refund eligibility, exclusions, and timelines is clearly disclosed prior to purchase.
    • No misleading representation, false assurance, or unfair trade practice is adopted.
  3. Refunds, if any, are governed strictly by the contractual terms voluntarily accepted by the Consumer, which is permissible under the Consumer Protection Act, 2019.
  1. Refund Eligibility Based on Mode of Payment

Refunds may be considered only if payment is made through:

  • UPI
  • Net Banking
  • Debit Card (full payment only)
  • Credit Card (full payment only)
  • Cash

Non-Refundable Payment Modes

Payments made through the following modes are final, irreversible, and non-refundable:

  • Debit Card EMI
  • Credit Card EMI
  • Education Loan / Financing / Third-Party Lending

Such exclusions are reasonable, transparent, and disclosed in advance and therefore do not constitute unfair trade practice.

  1. Absolute Non-Refundable Fees & Services

3.1 Recorded / On-Demand Courses

Fees paid for recorded, pre-recorded, or on-demand digital content are non-refundable under all circumstances, as such content is deemed to be fully delivered upon access.

3.2 INVESMENTOR & Subscription-Based Services

  • Fees paid for INVESMENTOR or any standalone subscription-based service are non-refundable.
  • If a subscription service is bundled with a course package, refund eligibility shall apply only to the course component, subject to other conditions of this Policy.

3.3 Seat Booking / Registration Charges

  • Seat booking, registration, enrollment, or reservation charges are strictly non-refundable, as they represent administrative, logistical, and opportunity costs.
  • Only if any excess payment made over and above Seat Booking / Registration Charges that balance amount  (excluding GST, taxes, convenience charges, and seat booking fees) may be considered for refund.
  1. Refund Eligibility:

Refunds for live instructor-led courses shall be subject to strict compliance with all the following conditions:

Special circumstances include –

  • In case if the course access is not provided.
  • In case, duplicate payment has been made by the customer. In such a case, the refund will be processed via the same payment channel as the original method of payment.

  1. Approved refunds shall be processed within 10-15 business days.
  2. Refunds shall be credited only to the original payment method.
  3. The following shall be strictly non-refundable:
    • GST or any statutory taxes
    • Payment gateway or convenience charges
    • Seat booking / registration fees
    • Any consumed or accessed services

The Company shall not be liable for delays caused by banks or third-party payment processors.

  1. Grounds for Refund Rejection

In accordance with Section 2(11) of the Consumer Protection Act, 2019, a refund request may be rejected where no deficiency of service is established.

Refund requests may be rejected where:

  • Eligibility conditions are not fulfilled
  • Services have already been substantially or fully rendered
  • The request pertains to non-refundable services or charges
  • The Consumer has accepted the service after full disclosure

The Company’s decision shall be final and binding, subject only to statutory remedies available under law.

  1. Consumer Forum–Ready Defense Clause

In any proceedings before a Consumer Commission, INVESMATE shall be entitled to contend that:

  • The Consumer voluntarily accepted the Refund Policy with full knowledge.
  • Services were delivered strictly as per contract.
  • No deficiency of service or unfair trade practice exists under Sections 2(11) or 2(47) of the Consumer Protection Act, 2019.
  • Claims seeking refunds contrary to disclosed contractual terms are misconceived, untenable, and liable to be dismissed.
  1. Limitation of Liability

To the maximum extent permitted under applicable law:

  • INVESMATE shall not be liable for indirect, incidental, or consequential losses.
  • Total liability, if any, shall be limited to the amount actually paid for the refundable service.
  1. Compliance with Consumer Protection (E-Commerce) Rules, 2020

INVESMATE confirms compliance with the Consumer Protection (E-Commerce) Rules, 2020, including:

  • Clear disclosure of refund policy and exclusions (Rule 4 & 6)
  • No misleading advertisements or representations
  • Accessible grievance redressal mechanism

  1. Governing Law & Jurisdiction

This Policy shall be governed by the laws of India, including the Consumer Protection Act, 2019.

All disputes shall be subject to the exclusive jurisdiction of competent courts and Consumer Commissions in India.

INVESMATE reserves the right to amend this Policy at any time. Updates shall be effective upon publication on the official website. Continued use of services constitutes acceptance of such amendments.

  1. Acknowledgment & Acceptance

By enrolling in any course or availing any service, the Consumer confirms that they:

  • Have read and understood this Policy
  • Accept all refund exclusions and limitations
  • Are aware of statutory rights under Indian law

If the Consumer does not agree with these terms, they are advised not to proceed with enrolment or payment.

Refund Process:

Upon receiving your written refund request, we will review it in a timely manner. If your request meets the eligibility criteria, we will process your refund within 7 to 10 business days. Refunds will be made to the original payment method used for the purchase, excluding GST and convenience charges.

Refund Denial:

We reserve the right to deny a refund request if it does not meet the eligibility criteria stated above.
